1. Legal Disclaimer
EnergyCymru provides independent home assessments to identify potential issues relating to insulation, ventilation, heating systems and renewable installations.
Our assessments are for informational purposes only.
We do not certify installation work, confirm regulatory compliance or provide legal, technical or structural engineering advice.
All recommendations offered in our reports are based on observations made at the time of assessment and the documentation provided by the customer.
2. Scope of Service
Our service is limited to:
- Visual assessments
- Documentation review
- Identifying potential defects or risk indicators
- Highlighting missing information or concerns
- Outlining recommended next steps
- Providing general guidance for contacting installers, warranty providers or relevant scheme bodies
We do not:
- Install, repair or remove insulation, heating or renewable systems
- Carry out intrusive investigations
- Perform structural assessments
- Certify PAS 2030, PAS 2035 or MCS compliance
- Provide a warranty or guarantee for past work
- Validate the accuracy of third-party documentation
3. No Legal Advice Statement
EnergyCymru is not a law firm and does not provide legal advice or act as a legal representative.
Any information relating to consumer rights, complaint pathways or escalation routes is general guidance only.
Customers are responsible for seeking independent legal advice where required.
4. No Certification / Compliance Statement
EnergyCymru does not act as:
- A PAS 2030 assessor
- A PAS 2035 Coordinator
- An MCS certification body
- A TrustMark inspector
- A government auditor
- A technical monitoring agent
Our assessments do not constitute compliance certification under any scheme, government programme or regulatory body.
5. Liability Statement
All findings are based on visible evidence at the time of assessment.
Conditions hidden behind walls, under flooring, within cavities or other inaccessible areas are not inspected and cannot be commented on.
EnergyCymru will not be held liable for:
- Installer actions or inactions
- Warranty provider decisions
- TrustMark or Ombudsman outcomes
- Future property damage or deterioration
- Customer failure to act on recommendations
Our liability for any claim arising from our services is strictly limited to the amount paid for the assessment.
6. Customer Responsibilities
Customers accept responsibility to:
- Provide accurate information and documentation
- Ensure safe access to the property for onsite assessments
- Communicate findings to installers, warranty providers or relevant bodies
- Follow recommended health and safety advice
- Seek professional, legal or technical advice where required
We do not contact installers, councils, warranty providers or Ombudsman services on your behalf.
7. Report Use Policy
Our reports are written in clear, legally safe language and may be provided to:
- Installers
- Warranty or guarantee providers
- TrustMark / certification bodies
- Ombudsman or ADR schemes
- Councils or LA Flex teams
Reports remain the property of the customer and may not be altered or reproduced for commercial purposes.
EnergyCymru does not offer expert witness testimony unless agreed separately in writing.
8. Health & Safety Statement
For safety and insurance reasons:
- We do not undertake any roof-access work
- We do not use ladders beyond safe domestic-use height
- We do not enter unsafe lofts, crawl spaces or restricted areas
- We do not remove insulation, boards, panels or fixtures
- We do not handle electrical components
Our assessments are strictly non-intrusive.
If an area cannot be safely accessed, this will be recorded in the report.
9. Payments, Cancellations & Refunds
Payment
Payment is required at the time of booking unless otherwise agreed.
Cancellations
- Remote audits (Bronze / Silver):
Cancellations must be made 24 hours before scheduled assessment. - Onsite audits (Gold / Platinum):
Cancellations must be made 48 hours before the appointment due to travel scheduling.
Refunds
Refunds may be issued where cancellations follow the above notice periods.
No refunds will be issued once an assessment has been conducted or a report has been completed.
10. Privacy & Data Handling Summary
EnergyCymru collects only the information required to provide the assessment and prepare your report.
This may include:
- Contact details
- Property address
- Photos
- Documents related to past installations
- EPC or retrofit paperwork
Your data is:
- Stored securely
- Never shared or sold to third parties
- Only used for your assessment and communication
